Australian Partner Visa General Overview
There are different versions of the Australian partner visa available, depending on your circumstances: For each type of application, evidence of your relationship is required. This varies depending on which visa you intend to seek. The application is made up of two parts –
- the sponsorship and
- the visa application
The Australian citizen or permanent resident acts as the sponsor and must consent to specific commitments; such as
- providing accommodation,
- financial assistance,
- information and advice to help their partner settle into life in Australia.
Partner Visa Applications, except the Fiancé visa, can be applied for either on-shore (from inside Australia) or off-shore (from outside Australia) If you apply from on-shore you will be entitled to a bridging visa which will have the same living and working rights that are applicable to the appropriate visa that has been applied for whist a decision is being made on the application. These visa categories are currently taking between 18 months and 2 years to obtain a decision after the application is submitted. All applicants must meet health and character requirements. Australian Partner De Facto Visa Application
The de-facto visa is suitable for couples who are living together, when one of them is an Australian citizen or permanent resident, this includes same sex relationships. The application process consists of two parts – the sponsorship and the visa application. The Australian citizen or permanent resident acts as the sponsor. The visa can be applied for either (on-shore) in Australia or from outside Australia (off-shore) If you apply on-shore you will be entitled to a bridging visa which will have the same conditions as the visa you are applying for. This option is not available if you apply off-shore To support your de-facto visa application, you must provide a variety of evidence including:
- Documents to confirm you have been living together for at least 12 months immediately prior to application
- Witness statements from family & friends confirming your relationship
- Relationship statements from each of you
- Joint financial/legal commitments
- Evidence of sponsor’s employment
- Knowledge of each other’s personal circumstances
- Passport photos
